Why this keeps coming up#

You have done the fact find. You know the assets, the pension nominations, the property tenure, the second marriage and the estranged son. Then the client asks who should write the will, and you refer them out — to someone who now has a relationship with your client, and who will be the one having the inheritance conversation with the beneficiaries.

Estate planning is the most natural adjacency in financial advice and the most commonly given away.

What you would need#

Competence first. This is not a plugin you switch on. Project Will run free UKRLP-registered training in wills, LPAs and trusts — UKPRN 10101187 — and it is free whether or not you buy the software. Do that before you take a fee for drafting.

Clarity on scope. Talk to your compliance adviser and your PI insurer about where will writing sits alongside your regulated work. We are not qualified to tell you and will not pretend to be.

Software that does not assume you draft all day. Guided questions, validation before anything leaves you, and a maintained clause set so you are not keeping precedents current alongside everything else.

What it looks like in practice#

Trusts are where the overlap is sharpest — property protection, life interest and discretionary trusts sit directly next to the IHT and care fee conversations you are already having. LPAs are the easiest addition and the most appreciated: a client whose parent has lost capacity without one will never forget who raised it.

Before you ask.

I'm not qualified to write wills. Can I?

Will writing is not a reserved legal activity in England and Wales, so there is no statutory barrier. That is not the same as saying you should start on Monday. Take the free training first — it exists precisely for people coming from adjacent professions — and be clear with your compliance function and your PI insurer about scope before you take a fee for it.

Does this affect my FCA permissions?

Will writing is not a regulated activity under FSMA, but how you structure and charge for it can interact with your existing permissions and your PI cover. Speak to your compliance adviser. We are not going to give you a comfortable answer to a question we are not qualified to answer.
